Law Enforcement Guidelines

These guidelines are for government and law-enforcement personnel who need information from MURAT DUMAN ("we", "us") about users of Basketball AI: Odds & Analysis. They explain how to contact us, what information we may have, and how we handle legal requests. We respect our users' privacy and disclose information only as required or permitted by law. These guidelines are not legal advice and do not create any rights for anyone, and we may change them at any time.

1. Where to send requests

Send all legal requests to one channel: dumanmuraat@gmail.com

  • Send requests from an official government email address, on agency letterhead where applicable, with the name, title, badge or ID number, agency, phone number and email address of the requesting officer, and a way for us to call back and verify.
  • Include the username, email address or other identifiers of the account, the specific records requested and the relevant date range.
  • We do not process requests sent to other addresses, through the app, or through social media. Please do not send requests to the support address.
  • Service of process by email is accepted for convenience only, and it is not a waiver of any objection, right or defense, including as to jurisdiction, validity or scope. We may require service by other means where needed.

2. Verification

We verify the identity and authority of every requester before responding. This can include checking that the email comes from an official government domain, calling back an official number, and reviewing the legal process. We may decline requests we cannot verify.

3. What information we may have

Depending on the account, we may have:

  • Account and profile information: account identifier, username, the email address and name provided by Apple or Google sign-in, sign-up and sign-in times, profile bio and picture, subscription status and device type.
  • Content: public posts, comments, quotes, picks and reports made by or about the account.
  • Logs: IP addresses and access logs, which we keep for 90 days.
  • Direct messages (planned): direct messaging is not yet available. When it launches, messages are kept for up to 12 months and then deleted.
  • Moderation records: warnings, suspensions, bans and reports, kept for a limited period.

We do not process payments ourselves. Payment and billing information is held by Apple and Google, which should be contacted directly. We do not have precise location data. We delete content that users have deleted, and we cannot produce what we no longer have. See our Privacy Policy for retention periods.

4. Types of legal process

We follow the Stored Communications Act, 18 U.S.C. § 2701 et seq. (the "SCA"), and other applicable law:

What you need What we require
Preservation of records A request under 18 U.S.C. § 2703(f). We preserve the records for 90 days, which can be renewed once for another 90 days. We place a hold on deletion for the account. A preservation request does not result in disclosure.
Basic subscriber and session records (such as name, email, username, sign-up information, IP address records) A subpoena (or stronger process)
Other non-content records (for example, detailed logs and other transactional records) A court order under 18 U.S.C. § 2703(d) (or a search warrant)
Content of communications, including direct messages and any private content A search warrant issued on a showing of probable cause
Emergency disclosure See Section 5

Civil subpoenas and requests in civil cases. We do not disclose the contents of communications, including direct messages, in response to a civil subpoena, which the SCA does not allow. We may respond to civil subpoenas for non-content information where valid, after notifying the user, and we may object to overbroad or improper requests.

Scope. We may object to or narrow requests that are overbroad, unclear, not properly served or not valid. We may require a narrower date range or fewer identifiers.

Information we publish ourselves. Public posts and profiles can be viewed by anyone, and we do not require legal process for information that is publicly available on the Service.

5. Emergency disclosure requests

We may disclose information without legal process where we have a good-faith belief that an emergency involving danger of death or serious physical injury to any person requires disclosure without delay (see 18 U.S.C. § 2702(b)(8) for content and § 2702(c)(4) for non-content records).

To make an emergency request:

  1. Email dumanmuraat@gmail.com with the subject line beginning "EMERGENCY".
  2. Provide your agency, your verifiable contact details and a phone number we can call back, the nature of the emergency and the nature of the danger, why the information is needed without delay, the account identifiers and the specific records you need.

We review emergency requests as quickly as we can. We may disclose only the information we believe is necessary to address the emergency. If the emergency is happening now, call 911 first. In-app reports are not monitored as an emergency service.

6. Notice to users

Our policy is to notify users about legal requests for their account information before we disclose, so they have an opportunity to object, unless:

  • we are prohibited by law or by a court order, including an order under 18 U.S.C. § 2705(b) (a gag order or non-disclosure order), from giving notice;
  • the request concerns an emergency or the notice would be harmful, for example where it could put a person at risk of harm or hamper an investigation of child exploitation; or
  • the account is clearly being used to endanger children or commit other serious crimes.

If you believe notification would be harmful, please include a request for non-disclosure with the legal order and explain the basis. We may delay notice for the period stated in the order, and we may notify the user after the order expires or is lifted.

7. Child exploitation and NCMEC reports

When we obtain actual knowledge of apparent child sexual abuse material or child exploitation on the Service, we report it to the National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. § 2258A. We preserve the reported content and related records for one year, under restricted access, and we cooperate with law enforcement agencies that investigate NCMEC reports. See our Child Safety Standards.

8. Costs and format

We may seek reimbursement of our reasonable costs for responding to legal process where the law allows, and we may waive fees in emergencies and in cases involving crimes against children. We deliver records electronically through a secure channel in common formats such as CSV or PDF. We do not provide live access or real-time surveillance unless a valid order requires it.

9. Records of disclosures

We log every disclosure we make: the requester, the date, the legal basis, the records disclosed and the person who approved it. We may use this log for our own compliance and to respond to questions from users or courts.

10. Requests from outside the United States

We may respond to requests from foreign authorities only where they are made through a valid process, such as a mutual legal assistance treaty (MLAT) or other process recognized under U.S. law. Foreign law-enforcement agencies should contact us through the appropriate U.S. channels. We may disclose emergency information where U.S. law permits.
